Children’s Care and Separated or Divorced Parents

At Compass Immunology Clinics, we’re committed to providing safe and appropriate care for every child. We also understand that sometimes things can get a bit more complex when parents are separated or divorced – particularly when it comes to communication and making decisions about their child’s healthcare.  

Your Parental Rights 
Unless a court order states otherwise, both parents of a child under 18 have the legal right to: 

  • Consent to their child’s medical treatment
  • Access their child’s medical records and information

    This applies regardless of custody arrangements or where the child lives. The exception is if the child is considered a mature minor, meaning they’re under 18 but capable of making their own healthcare decisions. 

If a Court Order Is in Place 
If there’s a court order that limits a parent’s rights to access information or make medical decisions, we ask that a copy be provided to our team. It’s also important to let us know if these arrangements change. 

Communication and Shared Information 
In situations where no court order exists, we expect that both parents will: 

  • Communicate directly with each other about their child’s care
  • Share relevant updates or medical information themselves

    Our team, including the independent specialists who consult from our clinics, are unable to act as intermediaries, relay messages, or provide separate updates to each parent about their child’s health outside appointment times.

When There’s Disagreement 
If parents can’t agree on a treatment plan, we ask that these matters be resolved privately or with legal support. In some cases, it may be necessary to involve the Family Court to determine what’s in the child’s best interest. 
Unless legally restricted, healthcare providers are permitted to proceed with treatment based on consent from one parent.
